TERMS AND CONDITIONS

By entering, accessing, using, participating in activities at, or otherwise utilizing the facilities, services, equipment, programs, website, or premises of HIT LAB LLC ("Company," "we," "our," or "us"), you agree to the following Terms and Conditions.

 

ASSUMPTION OF RISK

Users, members, guests, visitors, and participants acknowledge that participation in physical activities, fitness programs, exercise, training, use of equipment, and presence on the premises involve inherent risks, including but not limited to bodily injury, illness, disability, property damage, paralysis, or death.

Each individual voluntarily assumes all risks associated with entering and utilizing the facilities and services of HIT LAB LLC.

RELEASE OF LIABILITY

To the fullest extent permitted by Texas law, HIT LAB LLC, its owners, officers, employees, contractors, agents, affiliates, and representatives shall not be liable for any injury, illness, loss, damage, theft, accident, death, or other harm occurring on or related to the Company's premises, equipment, services, programs, or activities.

This limitation of liability applies regardless of whether such injury or damage results from participation in activities, use of equipment, interactions with other participants, or conditions on the premises.

Exception: HIT LAB LLC may be held responsible only where a claimant demonstrates through competent legal proof that an injury or damage was directly caused by a malfunction, defect, or operational failure of equipment, machinery, systems, or facilities that resulted from the Company's negligence, gross negligence, or failure to maintain such equipment in a reasonably safe condition as required by applicable law.

MEDICAL CONDITION DISCLOSURE

Participants represent that they are physically capable of engaging in activities offered by HIT LAB LLC and have consulted with a physician when appropriate. Participation is voluntary and undertaken at the participant's own risk.

HIT LAB LLC does not provide medical advice, diagnosis, or treatment.

PERSONAL PROPERTY

HIT LAB LLC is not responsible for lost, stolen, misplaced, or damaged personal property brought onto the premises.

Users are encouraged to secure valuables and personal belongings at all times.

PRIVACY AND INFORMATION SECURITY

HIT LAB LLC respects the privacy of its customers, members, and visitors.

We do not sell, steal, misuse, or knowingly disclose personal information to unauthorized third parties. Information collected is used solely for legitimate business purposes, including membership management, communication, billing, facility operations, legal compliance, and service improvements.

While HIT LAB LLC employs reasonable measures to protect customer information, no electronic storage or transmission system can be guaranteed to be completely secure. Users acknowledge that data transmission and storage carry inherent risks.

RULES OF CONDUCT

Users agree to:

• Follow all facility rules and staff instructions.

• Use equipment only as intended.

• Conduct themselves in a respectful and safe manner.

• Refrain from damaging equipment or property.

• Avoid behavior that may endanger themselves or others.

HIT LAB LLC reserves the right to suspend or terminate access to any person who violates facility rules or creates safety concerns.

INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless HIT LAB LLC, its owners, officers, employees, contractors, agents, and affiliates from any claims, liabilities, damages, costs, expenses, or legal fees arising from their use of the facilities, services, or participation in activities.

GOVERNING LAW AND VENUE

These Terms and Conditions shall be governed by and construed under the laws of the State of Texas.

Any dispute arising from or related to these Terms and Conditions, the use of HIT LAB LLC facilities, or any services provided by HIT LAB LLC shall be brought exclusively in a court of competent jurisdiction located in Chambers County, Texas 77523, unless otherwise required by law.

SEVERABILITY

If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

CHANGES TO TERMS

HIT LAB LLC reserves the right to modify, amend, or update these Terms and Conditions at any time. Continued use of the facilities or services constitutes acceptance of any revised terms.

ACKNOWLEDGMENT

By accessing or using the facilities, services, programs, website, or premises of HIT LAB LLC, the user acknowledges that they have read, understood, and agreed to these Terms and Conditions.
